The govt is set to put up the bill for consideration in the Rajya Sabha on Wednesday. As the govt doesn't have a majority in the upper house, it has engaged opposition parties in dialogue to ensure the legislation passes the upper house without a hitch to empower muslim women and protect their rights as well as dignity.

The Muslim Women (Protection of Rights on Marriage) Bill is listed for introduction in the Rajya Sabha by law minister Ravi Shankar Prasad on January 2, according to the list of business of the Upper House. The bill seeks to criminalise the practice of instant divorce among Muslims.

Congress is supporting the ban on instant talaq but has issues with the provision that makes it a penal offence, with a sentence of up to three years and fine.

BJP leaders feel the party gains both in getting the Bill passed on the same day - as it can then take credit for getting the landmark legislation passed that would win it some support from aggrieved Muslim women - and in it being sent to a select committee, as then the ruling party would go to town alleging Congress and others have delayed the Bill.

Under the law, instant triple talaq in any form - spoken, in writing or by electronic means such as email, SMS and WhatsApp - would be illegal and void.

When the Bill was in the Lok Sabha, most of the leading parties in the Opposition, including Congress, had voted in its favour.

The parliamentary affairs minister said the government may table the bill in Rajya Sabha on Wednesday.

On Tuesday, before the bill was tabled in the Rajya Sabha, the All India Anna Dravida Munnetra Kazhagam (AIADMK), the Dravida Munnetra Kazhagam (DMK) and others have noted their reservations over the bill and wanted it to be referred to a select panel of parliamentarians.

Meanwhile, the government urged the Congress not to press for amendments to the bill in the Rajya Sabha.

The amendments to the bill moved by the opposition too were rejected. We hope for a smooth passage in Rajya Sabha, " Mr Kumar told reporters here. There was, however, no official word from the Congress about the suggestion it was claimed to have made.
