After granting an earlier request for a preliminary injunction against a law that would have prohibited abortions because of genetic abnormality, race, sex or ancestry and would have mandated disposal of an aborted fetus through burial or cremation, Judge Tanya Walton Pratt of the U.S. District Court for the Southern District of IN struck down another portion of House Enrolled Act 1337 early Friday evening, ruling that the ultrasound mandate placed on undue burden on women seeking abortions, particularly low-income women. Friday, Judge Tanya Walton Pratt granted a preliminary injunction against the ultrasound requirement.
The judge, who heard arguments in the case in November, found that in provided no compelling evidence that requiring an ultrasound at least the day before an abortion, rather than on the same day, "makes it any more likely that a woman will choose not to have an abortion".
The provison's "burdens. on women seeking to terminate their pregnancies. dramatically outweigh the benefits, making the burdens undue and the new ultrasound law likely unconstitutional", Pratt wrote.
According to the lawsuit, Indiana's draconian abortion law prevented at least nine women from getting an abortion because they could not afford to make two trips to the clinic. House Enrolled Act 1337 went into effect a year ago.
Under SB 300 public entities will receive the highest priority for getting federal funds, followed by non-public hospitals and federally qualified health centers, rural health clinics and non-public health providers that have their primary objective as the provision of primary health care, including women's health services. Separate parts of last year's abortion law - provisions banning abortions performed because of the fetus' characteristics and potential disability and requiring medical facilities to bury or cremate fetal remains - were halted by a previous ruling.
